These Terms and Conditions govern all bookings for yoga retreats organised by Yoga Balance Ibiza. By completing a booking and making payment, the participant confirms they have read, understood and agree to be legally bound by these Terms.
1. Booking and Confirmation
A booking is confirmed once:
- A booking request has been submitted via the booking form
- The required non-refundable deposit of €200 has been received
Upon confirmation, a booking confirmation email will be sent containing a summary of the key terms and a link to these full Terms and Conditions.
An invoice (factura) will be issued upon receipt of the deposit and upon receipt of the final balance. Participants requiring an invoice with company details must provide this information to the Organizer.
2. Right of Withdrawal — Leisure Services Exemption
In accordance with Article 103(l) of Real Decreto Legislativo 1/2007 (TRLGDCU), the statutory 14-day right of withdrawal does not apply to this booking. This retreat constitutes a leisure service contract for a specific date and is therefore exempt from the standard distance selling withdrawal right.
The cancellation policy set out in Section 7 applies instead.
3. Retreat Package Inclusions
Retreat packages may include:
- Accommodation
- Daily yoga and meditation sessions
- Guided hikes and excursions
- Meals as specified in the retreat description (typically breakfast and lunch)
- Local transportation during activities
- Organised group experiences and workshops
The exact inclusions are specified in the retreat description on the website. The Organizer reserves the right to modify the programme due to weather, safety concerns or unforeseen circumstances while maintaining the overall retreat experience.
4. Items Not Included
Unless explicitly stated, retreat prices do not include:
- International or domestic flights
- Airport transfers (available on request)
- Travel, medical and trip cancellation insurance — required for all participants
- Visa costs
- Personal expenses
- Evening meals unless stated
- Optional activities not listed in the retreat programme
- Alcoholic beverages unless stated
- Tourist tax, payable directly at the hotel upon arrival
Participants are responsible for arranging their own flights and travel to the retreat location.
5. Travel Arrangements
Participants are responsible for arranging their own travel to and from the retreat location. The Organizer is not responsible for missed flights, delayed flights, visa issues or other travel disruptions. No refunds or compensation will be provided for missed retreat days, late arrivals or early departures due to travel disruptions or personal circumstances.
6. Payments
A non-refundable deposit of €200 is required to secure a place on the retreat. The remaining balance must be paid before the payment deadline specified at the time of booking. Failure to complete payment by the deadline may result in cancellation of the reservation without refund of the deposit.
7. Cancellation Policy
Cancellation by the Participant:
The €200 deposit is non-refundable in all circumstances.
Cancellations received in writing more than 30 days before the retreat start date: a full refund of all payments made beyond the deposit will be issued within 14 days.
Cancellations received 30 days or fewer before the retreat start date: no refund will be given for any amount already paid. We strongly recommend purchasing trip cancellation insurance to protect your investment.
No refunds will be given for no-shows or early departures.
Transfer of Booking:
Your booking may be transferred to another person with the prior written approval of the Organizer, provided the transfer is requested more than 30 days before the retreat start date. The Organizer reserves the right to decline a transfer if the replacement participant does not meet the requirements for the retreat.
8. Cancellation by the Organizer
The Organizer reserves the right to cancel a retreat due to safety concerns, insufficient participant numbers, natural disasters, travel restrictions, political instability or force majeure events.
Cancellation for reasons within the Organizer’s control: If the Organizer cancels the retreat for reasons within their control, participants will receive a full refund of all payments made including the deposit, within 14 days.
Cancellation due to force majeure: If the retreat is cancelled due to circumstances beyond the Organizer’s reasonable control — including but not limited to natural disasters, pandemics, government travel restrictions, political instability or acts of God — participants will receive a refund of all payments made, minus any non-recoverable costs already incurred by the Organizer on behalf of the retreat (such as non-refundable hotel deposits, guide fees or activity bookings). The Organizer will provide participants with a transparent breakdown of any non-recoverable costs deducted. Where possible, participants will be offered the option to transfer their booking to a future retreat edition as an alternative to a partial refund.
The Organizer is not responsible for costs related to flights, accommodation or other travel arrangements made independently by the participant. This is why comprehensive travel insurance including force majeure cover is strongly recommended.
9. Travel Insurance
Travel, medical and trip cancellation insurance is required for all participants. Participants must hold valid insurance before the retreat begins. The Organizer is not responsible for financial losses resulting from the absence of adequate travel insurance.
10. Health and Physical Condition
Yoga retreats involve physical activity including yoga, hiking and outdoor excursions. Participants confirm that they are in sufficient physical and mental health to participate safely in all planned activities.
Participants with any pre-existing medical condition, injury, pregnancy, physical limitation or mental health condition that may affect their participation must contact the Organizer at jana@yogabalanceibiza.com before completing their booking. The Organizer reserves the right to decline a booking or request medical clearance if the planned activities are not considered suitable for the participant’s condition.
Failure to disclose a relevant medical condition prior to booking releases the Organizer from any liability arising from that condition during the retreat.
11. Activity Risk Acknowledgement
Participants understand that yoga practice, hiking, travel and outdoor activities involve physical exertion and inherent risks including but not limited to falls, muscle injury and weather-related incidents. By participating in retreat activities, participants acknowledge that they voluntarily accept these risks and agree to practice within their personal limits at all times.
12. Participant Conduct
Participants agree to behave respectfully toward other guests, instructors, guides and staff at all times. The Organizer reserves the right to remove from the retreat any participant whose behaviour disrupts the experience for others or poses a risk to themselves or others. No refunds will be provided in such cases.
13. Liability
Yoga Balance Ibiza, its instructors, partners, guides and venues shall not be held liable for personal injury, illness, damage, loss, theft or expenses of any kind arising from participation in retreat activities, except in cases of proven gross negligence on the part of the Organizer.
Participants are strongly advised to hold personal liability and travel insurance covering all planned activities.
14. Accommodation
Accommodation is provided by third-party venues. The Organizer is not responsible for issues arising from the operation, maintenance or services of these venues. Any complaints regarding accommodation should be directed to the venue directly, with the Organizer’s assistance where possible.
15. Personal Belongings
Participants are responsible for their personal belongings throughout the retreat. The Organizer is not responsible for lost, stolen or damaged items.
16. Photography and Video
Photographs and videos may be taken during retreats for promotional purposes. Participants will be asked to sign a photography consent form upon arrival. Participants who do not provide consent will not be photographed or filmed for promotional use. This does not affect their participation in any way.
Images of identifiable individuals are treated as personal data under GDPR and will be processed in accordance with our Privacy Policy.
17. Privacy and Data Protection
Personal data collected during the booking process is processed in accordance with our Privacy Policy, available at https://yogabalanceibiza.com/privacy-policy, and in compliance with EU Regulation 2016/679 (GDPR) and Ley Orgánica 3/2018 (LOPDGDD).
18. Online Dispute Resolution
In accordance with EU Regulation 524/2013, consumers may submit a complaint via the EU Online Dispute Resolution platform at: https://ec.europa.eu/consumers/odr
The Organizer’s email address for dispute resolution purposes is: jana@yogabalanceibiza.com
19. Governing Law and Jurisdiction
These Terms and Conditions are governed by the laws of Spain. Any disputes arising from or related to these Terms shall be subject to the exclusive jurisdiction of the competent courts of Ibiza, Spain, unless mandatory consumer protection laws in the participant’s country of residence provide otherwise.
20. Acceptance
By submitting a booking form and making payment, participants confirm that they have read, understood and accepted these Terms and Conditions in their entirety.
